    KAREN READ V. EVERYONE - PT. 5

In this episode, we finish discussing the defendants’ responses to Karen Read’s complaint against the house defendants and police officers for conspiracy and malicious prosecution. Here, we break down the rest of the house defendants’ arguments—including statute of limitations, probable cause, and why, even taking Karen Read’s allegations as true, it still may not be enough to sustain her claims. We talk through the legal standards behind a motion to dismiss under Federal Rule of Civil Procedure 12(b)(6), what “probable cause” really means in practice (and why it’s so frustratingly subjective), and why we think Karen Read has an uphill battle. We also dive into the house defendants’ core theory: that they had no duty to tell the truth, had no control over the police investigation, and cannot be held liable simply for what they said to law enforcement—and why we agree that we don’t want witnesses to be scared to speak to police, even if what they are saying isn’t true.In response, Karen Read has filed a First Amended Complaint, and we walk through the new allegations and her attempts to tie everything together into a broader conspiracy narrative involving law enforcement bias, investigative failures, and alleged evidence manipulation. The information provided in this podcast is for informational and entertainment purposes only. GOSSIP CORNER - Afroman

In this episode of Gossip Corner, we are breaking down the Adams County Sheriff’s lawsuit against Afroman, and trust us, you don’t want to miss this. This case had us cracking up!It all starts with a 2022 raid on Afroman’s home based on a confidential informant’s claims of drugs and kidnapping, except no charges were ever filed. Afroman then turned his bad time into a good time and transformed his security footage into viral music videos like Lemon Pound Cake. After the raid, the deputies sued Afroman, claiming that his songs and use of the raid footage destroyed their reputations and exposed them to ridicule.Join us as we discuss what the confidential informant was, why this all started, the potential new album called “The Lawsuit,” and all the absurd and iconic details: officers testifying about lemon pound cake, ex-wives taking the stand, a pro se intervenor arguing that marijuana use makes someone legally incompetent, and the unforgettable and very on-brand way Afroman ended his deposition. The information provided in this podcast is for informational and entertainment purposes only. KAREN READ V. EVERYONE - Part 4

Join us as we continue to follow Karen Read's civil case and break down the initial responses from the police officers and house defendants to Karen Read’s complaint in federal coourt alleging conspiracy and malicious prosecution. We discuss why many of her claims may face an uphill battle—particularly because the law generally avoids punishing witnesses for speaking with law enforcement—and the ultimate question at the heart of the case: can witnesses be held liable for what they told police if it was a lie, or does the First Amendment fully protect them?We also cover the Anti-SLAPP motion brought by the house defendants, in which they argue that Read’s claims must be dismissed because they infringe on their First Amendment rights. According to them, they cannot be sued simply for speaking to law enforcement. We explain why this argument could pose a significant challenge for Karen Read moving forward. The information provided in this podcast is for informational and entertainment purposes only. Arizona (yes—Miranda was a person, and not a very nice person)! After a late-night crash, Karen Huger is charged with DUI and takes her case all the way to trial—despite her lawyers’ best advice. In this Gossip Corner/Case Brief crossover, we unpack the case: the accident, the body-cam footage, and the failed motion to suppress the video of her statements at the scene. CASE BRIEF - Sullivan v. NY Times - Part 2

In the conclusion of the Sullivan v. New York Times Case Brief, we pick up where the chaos left off—inside an Alabama courtroom that somehow decided the First and Fourteenth Amendments didn’t apply. From there, we follow the case through the Alabama Supreme Court and straight to the U.S. Supreme Court, where the Justices finally step in and do what the state court refused to do: follow the Constitution. We then read and discuss the Supreme Court’s 9–0 rejection of the state court and Sullivan, and explain the new rule: public officials can’t recover for defamation, even if the speech is false, unless they prove actual malice—knowledge of falsity or reckless disregard for the truth.Join us as we examine the Supreme Court decision that ensured the breathing room the First Amendment needs to survive, even when speech is false, uncomfortable, or unpopular. The information provided in this podcast is for informational and entertainment purposes only. CASE BRIEF - Sullivan v. NY Times - Part 1

In this Case Brief, we talk defamation and Sullivan v. New York Times, the Supreme Court decision that reshaped defamation law. But you can’t talk about defamation without first talking about the First Amendment. We begin by breaking down the scope of the First Amendment, including the protections—and limits—of the Free Speech Clause. We then turn to the historical background of the case and the United States in the early 1960s. Set against the backdrop of the Civil Rights Movement, we examine how a single full-page New York Times advertisement supporting Martin Luther King Jr., and the Greensboro Four Woolworth sit-ins, triggered a coordinated effort by Alabama officials to sue Northern newspapers for defamation in an attempt to silence criticism from the North. Finally, we dive into the Alabama jury trial that resulted in a verdict for Sullivan and an award equivalent to nearly $3 million against the New York Times and we read one of the craziest f-ing things ever said by a trial judge from the bench. Join us as we unpack the case that explains why public figures cannot sue their way out of criticism, and why the First Amendment still matters even when speech untrue. The information provided in this podcast is for informational and entertainment purposes only. CASE BRIEF - Donaldson v. O'Connor - Part 2

In the conclusion of our Donaldson v. O’Connor Case Brief, we break down the Supreme Court’s narrow but powerful ruling: the government cannot lock away a non-dangerous person simply because they are mentally ill, different, or inconvenient. We explore the Fifth Circuit’s controversial “quid pro quo” theory and the rejection of the “quid pro quo” theory, and the Court’s ultimate focus on liberty and due process over treatment.Join us as we dive in and examine the Supreme Court’s language about freedom, stigma, and public intolerance, due process, and what the decision in Donaldson v. O’Connor did and did not change with respect to the civil commitment of non-dangerous, non-violent mentally ill individuals, and whether it is fair to hold the doctors personally liable for the understaffing and failure of the government to provide for individuals in state-run mental institutions. This episode is about protections of the constitution, institutional power, and the uncomfortable truth that without due process protections, anyone could lose their freedom. The information provided in this podcast is for informational and entertainment purposes only. CASE BRIEF - Donaldson v. O'Connor - Part 1

In this episode, we dive into the haunting true story behind Donaldson v. O’Connor — the landmark civil rights case that exposed how the state can strip someone of freedom who was never dangerous and committed no crime. From brutal 1950s psychiatric institutions to constitutional law, we discuss how Kenneth Donaldson was civilly committed, denied care, ignored by doctors, and trapped for 14 years in a Florida mental hospital rife with abuse, where he received no treatment. But he fought back.Join us to discuss involuntary commitment, due process, constitutional power, civil liberties, and how Donaldson’s fight resulted in protections for everyone who may have been diagnosed with a psychiatric disorder. The information provided in this podcast is for informational and entertainment purposes only. This Gossip Corner, we chat about Sean Combs: The Reckoning, the Netflix documentary produced by 50 Cent that shot to the top of the charts. We walk through the series from start to finish—from Combs’s childhood and rise at Uptown and Bad Boy Records to the deaths, feuds, and allegations that have followed him for decades. We react to the documentary’s exploration of Sean Combs’ background, lawsuit, the interviews with former insiders, artists, and associates, and the claims tying Combs to industry violence, intimidation, and long-buried secrets. We also get into the most jaw-dropping moments, the people who chose to speak on camera, and why this documentary feels less like a single scandal and more like a reckoning years in the making. The information provided in this podcast is for informational and entertainment purposes only. In this Karen Read episode (for now!) we discuss the current status of O’Keefe v. Read and Read v. Everyone. We break down the discovery disputes in O’Keefe v. Read, including Read’s attempts to obtain all documents found on former Trooper Proctor’s phone and to depose Proctor, as well as the O’Keefes’ motion to force Karen Read to change her answer about who she believes killed John O’Keefe at 34 Fairview Road. We then discuss how and why the police officers sued by Karen Read moved that case to federal court. Karen Read v. Everyone - Part 3

In this episode, we go back in time to look at the statements made before and after Karen Read’s trial about the cause of John O’Keefe’s death, before the FBI got involved—statements that have since aged very poorly, turned out to be completely wrong, and, in hindsight, were incredibly foolish. We also dig into the FBI investigation into the Canton police and what the FBI concluded happened to John O’Keefe, and what didn’t happen—like being struck by a car. Then we give an update on the consequences for those involved in the bungled investigation. Spoiler: the consequences don’t exactly match the actions, except for Proctor, who both got what he deserved and was used as a scapegoat for the Canton police. This episode is part legal analysis, part historical analysis, and part two best friends just trying to understand how a police department could be this bad at investigating the death of one of their own. Karen Read v. Everyone - Part 1

The criminal case is over—and now Karen Read is fighting back. In this episode, we break down her explosive civil lawsuit accusing Massachusetts State Police and the so-called “House Defendants” of violating her constitutional rights and conspiring to frame her for John O’Keefe’s death. We unpack the federal powerhouse behind her claims—Section 1983—how it works when police allegedly abuse their authority, and why qualified immunity so often protects officers even when things go terribly wrong. We also walk through the jaw-dropping opening of the complaint, where her attorneys lay out a clear, methodical innocence narrative and alleged cover-up.We continue to follow along with the civil case that could finally answer what the criminal system didn’t: what really happened, and who should be held accountable. The information provided in this podcast is for informational and entertainment purposes only. CASE BRIEF: CANNIBALISM CASE - The Queen v. Dudley and Stephens

Welcome back to another Case Brief! Buckle up, because this episode delves straight into the collision of survival, morality, and murder. Is it ever legal to kill an innocent person to save yourself from certain death? Courts claim to have settled this long ago, but the answer may not be as simple as the law would have you believe. We begin with the 17th-century sailors stranded at sea who drew lots, killed the loser, and ate him—and what the court had to say about it. Next, we examine United States v. Holmes, where crew members threw passengers off a sinking boat to stay afloat. Then, we move on to the jaw-dropping British classic The Queen v. Dudley & Stephens, where sailors, adrift in the open ocean for 20 days on a dinghy after their boat was destroyed, killed a dying cabin boy to survive. Finally, we turn to a modern California case asking whether being forced by another person to kill an innocent third party can ever excuse a homicide. We’re providing you with the facts, the aftermath, and the rulings that shaped today’s doctrine: necessity, duress, the Court’s requirement that one resist, and the strict line the law draws when an “innocent life” hangs in the balance.Join us as we discuss ethics, cannibalism, survival instinct, natural law versus civil law, and pure legal chaos. Please note that the information provided in this podcast is for informational and entertainment purposes only. O'Keefe v. Karen Read - Part 1

Ready to grab a dram and gossip? Welcome back to Gavel and Gossip, where we're discussing the legal thriller that is the Karen Read case! The criminal acquittal might be over (at least for now, until a new grand jury in MA!), but the fight for money and accountability is just getting started, and we're dissecting the actual civil complaint filed by John O’Keefe’s heartbroken family. The family's lawsuit—filed after the first criminal trial ended in a hung jury but before the second—doesn't just target Karen Read; it also includes two Canton bars: C.F. McCarthy's and Waterfall Bar & Grill. The core of the complaint against Karen Read alleges she drove drunk, hit John with her SUV, and left him for dead in the blizzard. We're also breaking down the Dram Shop laws that hold bars liable for serving visibly intoxicated people, raising the question: were the bartenders negligent by keeping the drinks flowing? Finally, we also discuss new details pulled straight from the criminal appeal affidavit of Karen Read’s attorney, Alan Jackson, which reveal John O’Keefe’s clothes, all the way down to his boxer shorts, were saturated in blood and vomit! We discuss if this shocking evidence screams violent fight inside the house, lending credibility to the defense's cover-up theory, or if it is the result of Karen Read striking John O’Keefe with her car and leaving him in the snow. The information provided in this podcast is for informational and entertainment purposes only. It Ends With Us - Part 2 - In Propria Persona

Dive back into the courtroom chaos with Part Two of our discussion on the "pro pers" (self-represented litigants) involved in the Blake Lively and Justin Baldoni case.In this episode, we tackle the bizarre motions and arguments filed by other pro pers who tried to intervene in the ongoing lawsuit. We explain why a third party can intervene (when appropriate). Then break down the filings of two particular individuals, one who claimed the celebrity defendants were misusing his and his dog's likeness (including filing a picture of himself in the court record which we posted), and another who insisted on intervening because he had allegedly invested in a YouTube channel that received a discovery subpoena. We analyze why the judge was quick to deny these attempts at intervention, highlighting the difference between substantive and procedural law and why having a "remote interest" in a case is simply not enough. We also discuss how these strange filings use confusing legal terminology without proper meaning, often hurting the pro pers' own cause. Finally, we discuss the overall pattern of coordination and media strategy among these self-represented individuals and how Blake Lively's legal team ultimately withdrew all third-party subpoenas, including the ones that targeted celebrity blogger Perez Hilton.Tune in to find out just how wild the legal documentation got and how the judge handled the onslaught of "legally deficient" and utterly confounding motions. The information provided in this podcast is for informational and entertainment purposes only. It Ends With Us - Part 1 - In Propria Persona

Welcome back to Gavel and Gossip! This week, we dive into the chaotic world of pro pers (self-represented litigants) in the Blake Lively and Justin Baldoni case, focusing on celebrity blogger Perez Hilton.Lively's team served Hilton with a subpoena for documents because the TAG (PR) defense identified him as a witness they communicated with about Baldoni. This communication was also in writing, and we discuss the text message identifying Hilton as someone they could work with because he shares the same attorney as Justin Baldoni. We also discuss how, despite his claims, subpoenaing his records is a normal legal step.We then discuss the various letters and motions filed by Hilton, including his request to quash the subpoena and his arguments that he is a journalist whose sources were privileged and that he was "not a party" (which is, of course, the point of a subpoena!). We then read his federal court filings and discuss if he turned the federal court into a spectacle because of the rude letters where he accused the judge of being biased and the court of being a "circus," using demeaning nicknames for Lively and her counsel. This forced the judge to issue an order condemning the language used by Hilton (and the other pro per). Finally, we discuss why Hilton did not need to produce any documents and why, despite his claims of bias, the New York judge ultimately sided with Hilton (and no, it wasn't his amazing legal writing)! The information provided in this podcast is for informational and entertainment purposes only. It Ends With Us - Part 4 - Baldoni v. Lively

Welcome back to Gavel and Gossip where  diving back in to our discussion of the Justin Baldoni claims that were dismissed against Blake Lively, Ryan Reynolds, Leslie Sloane, and the NY Times concluding our discussion of the judge's reasoning for dismissing the defamation and false light claims. In this explosive episode, we zero in on the exact legal logic used by the judge in the Dismissal Order. We'll break down the crucial balance the court struck between the First Amendment—the right to free speech—and the severe claims of defamation. We'll explain what the court identified as the statements Baldoni and the Wayfarer parties claimed were defamatory, allegedly made by Blake Lively, Ryan Reynolds, Leslie Sloane, and The New York Times. You'll hear precisely what they were fighting about. Finally, we go straight to the source, reading directly from the judge’s order, including the judge finding Baldoni and the Wayfarer parties basic fundamental failure to meet the requirements for stating facts in their legal complaint, and the powerful privileges that, in the eyes of the court, protected the defendants' statements—even if those statements were defamatory.Join us as we react to this definitive legal conclusion and explain how the interplay of celebrity, claims of defamation, and free speech privileges sealed the fate of Baldoni's lawsuit! The information provided in this podcast is for informational and entertainment purposes only. GOSSIP CORNER: Kendra Licari

Welcome back to another Gossip Corner on the crazy story behind the documentary, Unknown Number: The High School Catfish. This story is insane, so buckle up!SPOILER ALERTFourteen-year-old Lauren Lacari and her boyfriend, Owen McKenney, were being cyberbullied by Lauren’s mom, Kendra Licari. The bullying included disgusting, vulgar, and body-shaming messages and instructions for Lauren to self-harm, as well as photos of Lauren with mean things written over them. We dive into the text messages and explain how the police, with the help of the FBI, tracked the number to a "Pinger" app, which disguises phone numbers—discovering the truth about Kendra Licari and her lies. We're bringing you all the legal details from our research that weren't included in the documentary. We found a bankruptcy filing from 2002 for Lauren's parents, Sean and Kendra, showing they had financial issues long before the bullying began. We also cover the Cut article that came out before the documentary in January 2025 and discuss how Kendra was fired from her job for "excessive time on non-work texting and calls" and lied to her family about it for a year, leading to the family’s financial issues and even more lies.We also reveal new information from a court hearing in December 2022, shortly after her arrest, where Kendra tried to get her no-contact order with her daughter lifted so they could spend the holidays together—which the court rejected. We also cover Kendra Licari’s sentencing and plea deal, her attempts to appeal to the Michigan Appeals Court after her sentencing, and read the Appeals Court's response. We then cover where Kendra is today and the probation requirements she's under until 2026. Finally, we ponder how and why a mom who claims to love her daughter would do something like this, what her attorney said, and what the psychological research says about “Munchausen by Internet.” We also share our opinions on whether her daughter, Lauren, could have known about her mother's actions and why we think Owen and his family and Khloe Wilson were all victims of Kendra Licari’s lies. We'd love to know your thoughts on this case! It Ends With Us - Part 2 - Baldoni v. Lively

Welcome back to Gavel and Gossip, where we're continuing our discussion of the bizarre legal battle between Justin Baldoni and Blake Lively. We’re going through the judge’s 132-page dismissal order, which lays out the most shocking and interesting facts from Baldoni’s complaint and the facts the judge thought were relevant and important on whether to dismiss the complaint.Baldoni and Wayfarer’s complaint alleges a series of escalating demands from Lively, which we found completely wild. Baldoni claims Lively was making “daily altercations to the script,” a right she seemingly felt she had as an executive producer. He also says she insisted on full control over her character’s wardrobe, including using her own stylist and even choosing $5,000 shoes for a character who was a small business owner. We also discuss how Baldoni created a "monster" by never telling Lively "no" to her escalating demands. The allegations get even more intense, veering into what could be seen as sexual harassment claims. The complaint seems to admit many of the alleged sexual harassment allegations but tries to explain and justify the actions. Baldoni's complaint admits that Lively felt uncomfortable when Heath looked at her while she was getting her makeup removed. The complaint also admits that Baldoni told Lively about his past pornography addiction but tries to explain and justify his actions.Join us as we react to Baldoni and Wayfarer’s factual allegations as described by the Judge in the Motion to Dismiss Order. The information provided in this podcast is for informational and entertainment purposes only. We'll introduce you to all the players, from the co-stars to the behind-the-scenes publicists, and explain the connections between the multiple parties in the lawsuit. We then cover why the judge accused Baldoni’s counsel of violating the Federal Rules of Civil Procedure and why Lively's counsel accused Baldoni's counsel of violating professional conduct rules by making "inflammatory extrajudicial comments" and why the judge ultimately denied the request for an immediate deposition of LivelyFinally, we read the court transcripts and discuss the aggressive tactics used by Baldoni’s attorney, who requested to depose Blake Lively immediately and "without any documents". We also dissect the stunning legal missteps that we believe derailed Baldoni’s case and led to the judge dismissing his complaint. GOSSIP CORNER: Amy Bradley

Welcome back to the Gossip Corner, where we're diving into the mystery of Amy Bradley's disappearance from a cruise ship in 1998 after watching the Netflix documentary “Amy Bradley is Missing”. This isn't just a true-crime story; it's a deep-dive into how legal battles, family trauma, and conflicting accounts have shaped a narrative for more than two decades.Join us as we debate two very different perspectives. For some, the evidence is clear: Amy was the victim of a sex trafficking ring, supported by multiple eyewitness sightings and a photograph from a sex worker website that facial recognition experts said was "highly likely" to be her. Her family's relentless search is a testament to a parent's unwavering hope and a desire to save their daughter from danger. But for others, the story is far more complicated. We'll discuss the families changing stories reading interviews given by the family all the way back in 1998 just a few months after Amy Bradley went missing. We also discuss why a court found the family guilty of "perpetrating a fraud on the court," allegedly lying in discovery responses, and hiding witnesses who contradicted their claims. We'll also examine the legal paradox of the family filing a wrongful death lawsuit, an action that some can be argued directly contradicts their public plea that Amy is still alive. We'also dissect the most sensational claims, from a witness who saw a kidnapping plot discussed in a bathroom, to a Navy officer in a brothel who claims to have seen her in a brothel.Amy Bradley is still missing, but what really happened to her remains fiercely contested. We'll debate whether the family's ever-changing stories are a sign of trauma or deception. RICO and Sex Trafficking - Part 3 - Sean Combs aka P. Diddy

Welcome back to Gavel and Gossip for our final episode of our deep dive into the civil complaints against Sean "P. Diddy" Combs. This time, we're focusing on the lawsuit brought by former model Crystal McKinney. McKinney claims Diddy's actions in 2003, when she was 22, led to her being "blackballed" in the industry, resulting in a downward spiral of depression, anxiety, and even a suicide attempt in 2004. We'll discuss the disturbing similarities to previous Diddy allegations, including being plied with alcohol and a laced joint, and then sexually assaulted in a studio bathroom. But that's not all—we also explore the fascinating connection to Harvey Weinstein, as McKinney has filed a strikingly similar lawsuit against him, alleging a separate, horrific assault involving her roommate. Listen in as we dissect the judge's astonishing order in the Weinstein case, denying McKinney's request to proceed anonymously. This judge's commentary in the order regarding McKinney will leave you speechless, especially the judge's statement that "the person who is responsible for any damage to Jane Doe is Plaintiff herself".This episode tackles the nuances of the New York City Victims of Gender Motivated Violence Protection Act, including its "revival window" that allowed McKinney to bring her 2003 claims over two decades later. We'll discuss concepts like preemption and controlling precedent, and how legal battles regarding "preemption" are playing out in the appeals courts. You won't want to miss our discussion on these intertwining, high-profile cases and the powerful legal arguments being made. We'll unpack the shocking details from Jones's declaration, a document he signed under penalty of perjury alleging that during his time working on Combs's album, he witnessed and was forced to participate in a "calculated grooming scheme" involving sex trafficking, drug use, and threats, including one where Combs allegedly threatened to "eat his face"Join us as we discuss the dramatic legal setbacks and victories in the case. We'll expose the judge's scathing "Warning to Counsel" to Jones's attorney, describing his filings as "replete with inaccurate statements of law" and "schoolyard taunts".
