    ReTrial Week 9: Karen Fread

    Week 9 began on Monday, June 16th. The deliberation clock had barely any time on it, seeing as they had been sent into deliberations on Friday afternoon for hardly 2 hours. We knew the work of really digging down into the case, began Monday. While some were confident that the case was open and shut and a verdict would be returned in mere hours.....others understood the gravity and heaviness of what was being asked of this jury. The mounds of evidence and confusing juror slips were only the beginning. However, they stayed the course. On June 18th, 2025, just before 3:00pm EST, the jurors and court reconvened with a verdict.     Retrial Weeks 7 & 8 Recap: ARCCA, Barka and Snarka

    The Defense's Case in chief was presented over weeks 7 and half way into week 8. Wrapping up the trial were defense witnesses who represented ARCCA (the crash daddies), a new medical examiner, and some original and dependable witnesses that came back for season two, including Dr. Russell and Lucky with his Franken-Truck. The Cross examinations became very heated however, leading to 2 mistrial motions on behalf of the defense for unethical and egregious behavior by the state's prosecutor, as well as some overall snark and general "I've Had IT" moments with Jackson and Brennan bickering in open court. Bev lost control of the courtroom and it was a good thing this was approaching the end.     Retrial Week 6 Recap: Kinky Cosplay, Method Actor or Scientist?

    Week 6 closed out the month of May and the Commonwealth's case in chief. During the Week 6 trial days, we met a new engineer. He goes by the name of Dr. Judson Welcher. If you watched the trial and testimony live, you became very familiar with his strategy....which seemed more like a magic trick than actual scientific testing. Dr. Welcher pulled a page out of a Stephen King thriller or Barbara Schroeder film. He "oosurped "(or attempted) John O'Keefe's life. He all but had Karen call him 53 times in a row just to ignore and send to voicemail, in an attempt to truly prepare for this method style acting.Covered in blue grease paint, his slight of hand tricks left everyone watching with less answers than we had before. He could not confirm an actual speed at the point of alleged impact. He could not confirm the position of John's body at the point of alleged impact. He could not use a crash test dummy. He could not behave himself in court.     Retrial Week 5 Recap: Stolen Educational Valor

    Week five was a short week. Monday and Tuesday were full days and Wednesday was a half day, ending just in time for the crew to get to Cape Cod for the long weekend. Crack the hard seltzers y'all...this week was short but eventful.Commonwealth's case in chief continued with calling more DNA experts to the stand to testify to items tested for John O'Keefe's DNA as well as the testing of Trooper Proctor and Bukhenik's buccal swabs.After they were done questioning experts about DNA, Shann Burgess was called to testify. And boy did he. There has been a lot of chatter following this expert (or is he) testimony. Alessi dug up everything on this guy and taught us some new SAT vocab. Mendacity. Do you know what it means? You do after week 5!

    Retrial Week 4 Recap: Tail Lights, Solo Cups and Magical Mystery Hair Tour

    Holy Science! After the spicy sauna session with Bukhenik, the Commonwealth proceeded to call a lot of witnesses to testify about evidence collection, DNA testing, tail light reconstruction and magical mystery hair. This episode is the follow up to our last episode, which finished week 3 and started on week 4 because they just weren't done with Sergeant Bukhenik.Trial Days 15-17 included testimony from Officers Clarke, Gallerani, Brent as well as Maureen Hartnett, Dr. Irini Scordi-Bello, Ash Vallier and ended with a Rule 14 violation and motion to exclude changes to an expert witnesses' testimony and report.

    Recap Week 3 Part Two: Hyde, Sneaker, No Nudes So Far

    Last week, the panel of witnesses was robust and so I decided to break up the recaps because Jessica Hyde and Officer Bukhenik were very important to the Commonwealth's case in chief. They are also important witnesses for the defense in terms of cross examination. Attorney Alessi, of course, handles Ms. Hyde with respect and dignity, while also showing her where she is wrong. Alan Jackson then spent a grueling 3 days trying to extract information from Sergeant Bukhenik. Pulling teeth has to be easier. During the Commonwealth's direct questioning, they interestingly position Sergeant Bukhenik as though he was the co-Lead Investigator on the case. More new information is revealed, including never before heard texts, never before seen video, and never before believed excuses.

    ReTrial Week 3 Recap: Hyde And Sneaker

    As week three of the retrial of Karen Read closes out, the Commonwealth's case in chief continued. They expeditiously presented multiple witnesses that jumped on and off the stand, including civilian witnesses, law enforcement, expert witnesses and the new voice for the Mass State Police, Sergeant Yuriy Bukhenik.The most stable and unwavering testimonies came from the witnesses who were brought up to testify to not having seen John in Karen's car, on the front lawn, or really anywhere on the property.Jessica Hyde, the digital forensics expert was also brought in to give Creedence to the fact that the Hos Long To Die In Cold Search hadn't happened at 2:27am on January 29, 2022....but don't count your chickens before they hatch. Sgt Bukhenik is still also on the stand and cross hasn't finished. We'll come back with part 2 of this witness line up once Bukhenik's testimony is officially concluded. He's stewing all weekend, knowing that Monday morning, he's getting more action Jackson for breakfast.

    ReTrial Week 2: New Highlights, Who Dis?

    Here is a recap of the second week of retrial in the prosecution of Karen Read for the death of officer John O'Keefe. This week, Ian Whiffen returned for a masterful cross-examination by attorney Bob Alessi. The crash daddies, Dr. Wolfe and Dr. Renschler also returned for yet ANOTHER voir dire. I'm starting to think Judge Cannone just wants the crash daddies in her court room as much as possible. Rawr!And then, the moment many were waiting for with baited breath. Enter witness Jennifer McCabe? New Highlights, new spray tan, new demeanor, who was this? Her glow up for 2.0 was just the beginning of the chatter. What was further learned regarding Jen's additional phone calls that were missed in 1.0 and her special visit from salesmen (or so she said), was astounding. Jen's T-Mobile 5 friends, we now know are Matt McCabe, Kerry Roberts, Peg O'Keefe, Brian Albert and D.A. Morrissey's office. Did Alan Jackson destroy her credibility? Or, did the jury buy her new "I'm just a normal soccer mom" persona? What say you?

    Retrial: Week 1 Recap Was Nutty Y’all

    From opening statements to the first few witnesses, a field trip and more, week 1 is officially over. For any listeners who have not watched the first trial which ended in a mistrial in July of 2024, this episode not only recaps the testimonies and happenings in the first week of retrial, but also compares and contrasts some of the strategic and testimonial changes between this trial and last.Hank Brennan approached the opening statement in a story telling format, while the Defense’s Alan Jackson shifted to reasonable doubt versus Karen being framed. In just the first week, Alan Jackson and David Yanetti have masterfully pointed out the discrepancies in testimonies, even getting Kerry Roberts, a key witness for the prosecution, to admit to committing perjury.

    Retrial: You Mad Bro?

    As we approach open statements and the official trial start, the jurors have been selected and there are still motions rolling in. The originally intended start date of April 14th, was pushed back, yet again, due to the hunt for a proper jury. Eighteen in total have been selected; 9 men, 9 women. They utilized their time together last week to review outstanding and new motions, including the entire dog pound. Who let the dogs out? Everyone. Judge Cannone is letting all the dog experts in. In addition to dog talk, we heard more ARCCA bellyaches and a request to hire actors to play the roles of Karen and John. If you are up for a good laugh, tune into Nurse Kim's channel on YouTube and watch the epic read from her, Auntie Deb, Will The Glarer and Attorney Melanie Little. And finally, the motion to quash the sequestration of witness Aidan Kearney was heard and Judge Bev did not disappoint! When she fan girls, we fan girl too. The pendulum seemed to swing in Read's favor last week. This made Brennan big mad. He went from Nicki Minaj pink to Jessica Rabbit hair red in the face.

    Retrial: What's For Lunch?

    The Yan-Yetti cooler is packed. What's for lunch? Only the healthiest snacks for the Greek Gods, standing alongside Karen Read on Mount Olympus (AKA Dedham Courthouse). 16 jurors have been selected, giving the court four alternates if need be, with a possibility of screening for 2 more before opening arguments on Tuesday.     Trial 2.0: Can I Get A Witness?

    On April 1st, the search for jurors began and that officially marks the start of 2.0. The court upheld its start date and each day, the panel of potential jurors is brought in to be screened by her honor Beverage Cannone as well as attorneys for the prosecution and defense. Each day starts with Judge Bev rifling off what it means to be a juror and the importance of the civic duty. She reads a quote by John Adams and then tells them that "Lots' of jurors love jury duty!" Before individually screening each potential juror, they must pass a series of questions as a group. Perhaps the most important questions are....."Have you heard about this trial before?' and "Do you know or recognize any of these people?"The people Judge Cannone is referring to are the list of 150 names on the combined witness list. This episode, hostess Pro Hawk VeeJay pulls the eye catching changes and names, citing the differences between 1.0 and 2.0.Despite Michael Easter's name being on the list....that is one witness the judge declined to allow as an expert witness. However, the defense team could still appeal it and it's best to mention the name in an effort to be overly cautious while screening potential jurors.Welcome to Season 2!

    Pre-Trial: Judge, Jury, Executioner........Lawyer?

    There's a new kid in town and then someone was voted off the island. This episode, Pro Hawk Veejay covers the latest esquire added to the defense team as well as the final determination for Michael Proctor. A few more motions were also discussed on March 26th as well as a determination on the motion to dismiss. Welcome to the show!

    Pre-Trial: Motions Hearings...DO IT!

    This episode is a run down of the hearings for motions in limine. Although not all motions have rulings as of yet, some do and we learned that Judge Cannone can actually rule for the bench. She was able to decide instantly after hearing both the defense and Commonwealth that a continuance of the trial would not be permitted. Due to the over 2,000 summonses that have been sent out in Norfolk County in search of an impartial jury, empaneling may take just as long as the requested continuance suggested would be. Also, the SASS from defense was palpable. They've had enough of being bullied. In the words of Attorney Jackson, if you think you can challenge their experts...."DO IT."

    Pre-Trial: Motions & Lemonade Pt. 2

    As promised, a second half of the motions in limine filed by counsel. While the majority of this episode focuses on what's been filed by the Commonwealth, we did kick off the episode with three more gifts from the defense. The first motion is my man Bob Alessi not taking no for an answer. Will Judge Cannon reconsider her stance on Crosby?We still don't have any decisions, however, the amount of reading the judge has to do, means she'll definitely need to hear these out on the 18th and 19th before really deciding.

    Pre-Trial: Motions & Lemonade Pt. 1

    Today's episode is just a review of the 10 motions in limine that were dropped by the defense. Motions were due on March 10, 2025 and they all hit the docket today. 10 filings on both sides are available for review and cover everything from excluding the Sullivan sister requests, asking that the McAlberts not linger before or after their testimonies and a few other requests. This episode we cover just the defense's "motions and lemonade". Another fun game? Who do we think will cover each motion?Which motions will Judge Bev allow? We won't find out until next week, but maybe we can place some bets for entertainment sake.

    Pre-Trial: Coming in Hawt...Going Out Cold.

    As expected, this has been another motion filled week with some decisions yielded. The week began on March 4th with a motions hearing, picking up where the teams last left off. Judge Cannone came in quite HOTTTT. She started by lining up the defense team in front of the firing squad. Once she reprimanded them like children, the drama ensued, per usual. This episode, Pro Hawk Vee Jay reviews the motions to exclude ARCCA, motions to exclude Dr. Crosby and the motion to exclude the hard as a rock dude....Rob Gillman. Oh...and of course, the motion of all motions. The motion to dismiss.

    Pre-Trial: Return Of The Mack Bob Alessi

    The prince who was promised returns to Norfolk County. With binders and SAT Vocab words, he disarms his opponents and endears the impermeable, Judge Cannone. Five hours, two breaks, and a few "not so fast Brennans" later, the presentation to argue whether or not the Defense Counsel had "duped" the Commonwealth and committed an ethical violation, was over.     Pre-Trial: Wicked Verklempt

    What's the big hullabaloo? The inter webs are all a dither given the abrupt halt to the motions hearing on February 18th. The Ocean of Motions ended with an Ocean of eMotions as Judge Cannone appeared to be rattled. Was it something Hank said? Was it something in her chambers she saw? A mouse under the bench? We may not truly know the answer until all parties reconvene on the 25th to continue the hearing per the order to appear issued by Judge Cannone to all parties. This is the trial that keeps on giving...and we are only in pre-trial. Saddle up friends. We've got more waves to ride and oceans to fly over.

    Pre-Trial: Ocean Of eMotions Pt. 3

    Holy smokes....today ended abruptly. After a week of filed motions and affidavits, today's hearing date was highly anticipated. Both the defense and commonwealth were able to successfully review motions until the ARCCA motion was on deck. Is the defense team facing sanctions? Did Attorney Brennan mess up royally in his delivery by inferring a discovery violation occurred when it hadn't? Did a violation occur? Just a brief overview until we get more information regarding some answers.

    Pre-Trial: Ocean Of Motions Pt. 2

    This is the second part of our "Ocean of Motions" review. On February 11th, all discovery and motions were due and so the bombardment occurred. We pick up with a brief review of Part 1 and continue with the motions for more journalist notes and edited footage. The commonwealth has filed a request to amend the Gretchen Voss redacted notes ruling as well as a request for notes, audio and video that were edited out, but in possession of Fox 25 TV in Boston. Ted Daniel, a reporter and journalist for Boston's Fox 25 had and exclusive interview with Karen Read that aired following the Superbowl.Additional motions covered in this episode are the addition of attorney Mark Bederow to the DREAM team as well as his representation of Doctor Turtleboy in a separate but related case.Finally, we cover the motion for reciprocal discovery and the defense's motion to reconsider the ruling on reciprocal discovery. There's a lot more to still review, but lets take it from here fellow hawks!

    Pre-Trial: The Ocean of Motions Pt. 1

    With a due date of February 11th for Motions and Discovery, there's no surprise that both the Commonwealth of Massachusetts and the Defense team for Karen Read went to town like a college senior at 3:00am with a final paper due by 8:00am. Not only was there an influx of motions, an ocean of motions if you will, but we also had some additional surprises on February 11th. This episode is part one, covering the motion to extract and obtain forensically sound video footage of the sally port surveillance system, The Supreme Judicial Court's Decision on the appeal on behalf of the defense regarding the verdict and possible commitment of double jeopardy, the motion to obtain Fox 25's audio and video footage as well as journalist Ted Daniel's notes and finally, the latest addition to the DREAM TEAM. We aren't even half way through this subject matter. Wings up hawks! We are ready for flight!

    Pre-Trial: Lally's Cheeks

    Did you catch the February 6th motions hearing in Dedham District court? Well, if you did, you might have been just as uncomfortable as the rest of us as both Alan Jackson and Hank Brennan agreed that the dumpster fire before them was delivered by an unspecified predecessor. As ADA Adam Lally sat there, I prayed for the camera to zoom in, however.....no such luck. Welcome to another episode of Retrial....where we discuss the on-going shenanigans before trial 2.0. Will the motion for cost recovery be approved? IS there still Sally Port video out there? Does Lally need an ice pack for those glutes? Yikes.

    Pre-Trial: Battle Of The Experts Pt....Never Mind

    Things are moving quickly as we loom towards April 1st and the determined date for Trial 2.0 to begin. As a follow up to Battle Of The Experts first part episode, this episode answers some of the questions that we were left with on Friday. Judge Beverly Cannone returned two notes and responses to motions heard on Friday morning. The first was her response to Boston Magazine reporter Gretchen Voss Third Party filing. The motion sought to prevent Ms. Voss from having to turn over personal notes. The second motion heard was the request to qualify Richard Green as a defense expert via the Daubert-Lanigan hearing process. The judge responded and requested that both the Commonwealth and Defense be ready for more motions to be heard this week coming up. Stay tuned for more follow up at the end of the week regarding the still outstanding motions.

    Pre-Trial: Battle Of The Experts Pt.1

    Oh so many motions! The second episode this week and it's only the beginning. The hearings of motions continue while new ones are simultaneously being dropped and responded to. The defense team has requested to cancel the Daubert-Lanigan hearing of forensic digital expert, Richard Green. However, before they get to that, an additional amicus brief had been filed by Boston Magazine reporter, Gretchen Voss. In this episode, an update as to the motion for discovery of the journalist's notes which had been partially redacted is made by the Commonwealth, while Gretchen Voss, as a 3rd party, is requesting to not un-redact as well as consider excluding the sharing of all of her audio recordings and hand-written notes from June 2023, when she sat with Karen read for an interview. Ms. Voss Article, A Killing That Tore A Town Apart, has been the subject of discovery. The Commonwealth is convinced that the journalist is sitting on Inculpating evidence. Did Karen confess? We continue with the defense's request to cancel the Daubert-Lanigan hearing of expert, Mr. Green. We continue with Spicy Alessi's argument in Part 2......but first, tune in to catch the first part.

As of right now, they're looking for the state to cover their blunder in misleading an expert and sending him on a wild goose chase. What bigger ramifications could this snafu have?

    Pre-Trial: Dog Bites Dog Bleeds With Dr. Russell

    Dr. Marie Russell recently concluded her second day in a Daubert-Lanigan hearing, in order to requalify as an expert for Trial 2. In this episode, you find out who Dr. Russell is and we condense almost 14 hours of hearing time into 30 minutes to highlight her experience, what the Commonwealth's challenges to her testifying are and finally, what was Judge Cannone's determination post hearing.
