Is the whole purpose of limud hatorah is in order to know the halacha ("תלמוד גדול שמביא לידי מעשה"). Do you get up bemesirus nefesh at 5:30am every day to find some nuggets of halacha lmaaseh in maseches erchin and kiddushin? Do you not leave the page until you check out the Shulchan aruch? “Mevatlin talmud torah le’mikrah megillah”. Why is listening to the megillah not considered limud hatorah? Enjoy!!

העושה מצוה אחת מטיבין לו This recording addresses several fundamental questions: Our משנה tells us the fortunes of a person (מטיבין, מריעין) are dependent on his having רוב זכויות. Is this separate from the din of ראש השנה or is this משנה  referring to the din of ראש השנה? Many פסוקים spell out that if you do hashems will then there will be abundant good, and if not… How do we reconcile this with the שיטה  of ר' יעקב of "שכר מצוה בהאי עלמא ליכא"? This shiur offers a proper perspective of all the good we have received, and clarifies the essence of Rosh Hashanah. Enjoy!!    

Is the הללמ"ס that said that there is an איסור ערלה in חו"ל, a standalone halacha, or is it an explanation about the parameters of the פרשת ערלה and really is included in the torah with all the ramifications that come along with that? Is the איסור ערלה בחו"ל an אסור גברא or is it an איסור חפצא ? The gemara says that the היתר of ספק ערלה בחו"ל allows you to give ודאי ערלה to your friend, and it is completely מותר for him to eat as long as he doesn’t know of the issur. How can this be considered a ספק, when it is אפשר לברורי בקל? Enjoy!!

The חיוב מצות of עבדים כנענים are learned and limited to the mitzvos that women are mechuyav.  Does this give us new insight into  the explanation why מצות עשה שהזמן גרמא is considered its own category?  Come tomorrow and hear a THIRD explanation in this intriguing issue. Enjoy!!

Issues to be discussed in this shiur: What is the טעם  that ladies are פטור ממצות עשה שהזמן גרמא? Does the טעמי המצוות  define for us the parameters of the הלכה? When do we use "טעמי המצוה" as a criteria for הלכה, and when do we say that it only serves an indicator of the general values that we should have?

מצות עשה שהזמן גרמא Why does Rashi give two different definitions for זמן גרמא: * "שהזמן גורם לה שתבוא" * "כיון דאיכא שעתא דלא מחייב בה" This “shtel” is a “furshpeiz” for tomorrows shiur.  Enjoy!!

מצות עשה שהזמן גרמא – סימן או סיבה The following is similar to the Avudraham we mentioned. ספר כלבו סימן עג - לפי שהנקבה היא לעזר הזכר ואל אישה תשוקתה והוא ימשול בה להנהיגה ולהדריכה בדרכיו ולעשות כל מעשיה על פיו והיותה על הדרך הזה הוא סבה ג"כ שהיא פטורה מכל מצות עשה שהזמן גרמה כי אלו היתה טרודה לעשות המצוה בזמנה היה הבעל בלא עזר בזמנים ההם והיתה הקטטה נופלת בהם, ותסור הממשלה המכוונת לתועלתו ולתועלתה. כלום תורה עומדת מפני לומדיה   While one is learning he does not get up for his rebbi, because he is "תורה" and we say כלום תורה עומדת מפני לומדיה. Is this true even if he could continue learning while he stands? Why does someone have to stop learning for a מצוה שאי אפשר לעשות ע"י אחרים, why don’t we apply the rule of עוסק במצוה...? BEWARE!!! לכבוד חנוכה we are shtelling some heavy lomdus from R’ Shlomo Feivel Schustal. This is the "כפתור ופרח" of the תורה שבעל פה  that is represented in the menorah.  

לעמוד מפני ספר תורה Which is greater, כבוד ס"ת or כבוד ת"ח? Is כבוד ס"ת limited to standing for the ס"ת, or does it include all forms of כיבוד ומורא? Does it make a difference if the opening to the בימה is on the side or in the back? בנו והוא רבו – part 2 The גמר' has two נידונים, with no conclusion. Why did the רמב"ם choose כיבוד אב over כיבוד רבו? What is the halacha of a גדול הדור? To what extent does the רמב"ם pasken like the ירושלמי?

בנו והוא רבו – part 1 Why can’t they both stand for each other? Why is there an “either or”? Is there a דין to stand up for a בעל מעשים? Is the נידון with a son that is a רבו מובהק or even a רבו שאינו מובהק?

כבוד אבי אביו Is there a chiyuv kavod for your grandfather? What is the mekor? Is the chiyuv bein adam lamakom or bein adam lechaveiro? Can you think of 10 נפק"מ ? Is there a chiyuv to honor your in-laws? (It is probably a good idea anyways- והמבין יבין) This sugya will be a springboard to cover many of the חקירות that are the foundation of understanding the מצות כבוד אב ואם!!!! Is כיבוד אב ואם about giving them honor, or about fulfilling their needs and requests? Is the chiyuv כבוד אבי אביו because they have the din of a father (בני בנים הרי הם כבנים) or something else? What is the explanation for the sevara "אתה ואמך חייבין בכבוד אביך"? Part 2 - לפני עור במידות רעות * Why did ר' ישראל סלנטר  say that to do something that causes someone to express bad middos is not in the parameters of the issur לפני עור  * Is there an issur to get angry (המעשה), or is the issur to have the middah of anger (המדה) ? Discover two more explanations for this puzzling saying from ר' ישראל סלנטר. Enjoy!!

Part 1 - לפני עור במידות רעות * Is there anאיסור לפני עור  to do something that will cause someone to say לשון הרע  about me? * What is the חיוב to have middos? * Why is it מותר  to say לשון הרע לתועלת? Listen to this all encompassing definition of all מצות בין אדם לחבירו that has tremendous ramifications!!!

כיבוד אב ואם – בין אדם לחבירו   או  בין אדם למקום * What is the מצוה of כיבוד אב ואם really about? * Why is it from the first 5 of the עשרת הדברות which are reserved for מצות בין אדם למקום? * Isn’t the mitzva about הכרת הטוב to your parents, why does this deserve to be הושווה כבודם לכבוד המקום? * Do you have to have actual respect for your parents, or is it enough to do acts of respect?  * What is the purpose of all מצות that are about כבוד (ex כבוד ביהכ"נ, כבוד רבו, כבוד ס"ת…)? * Can I be מוחל as I please, or is there a criterion to my מחילה? How does this mitzva relate to חינוך הבנים? Enjoy!!

* Why does the גמרא illustrate "עד היכן כיבוד אב ואם"  with a story of an עכו"ם? * Why was a פרה אדומה the appropriate reward for כיבוד אב ואם? * The  גמרא  on .לב also asks "עד היכן כיבוד אב ואם" and gives a different answer?   Enjoy!!

  * Why is he called a "אינו מצווה ועושה", we find that גויים are מחוייב in all מצות שכליות? * Did his father really not want to be woken up, and lose all that business? * The חיוב  of כיבוד אב  is not מחייב  the son to lose money ("משל אב") so why did Dama take such a huge loss? Enjoy!!

אשה נשואה פטורה מכיבוד אב Is the פטור  only when there is a conflict with the husband or does an אשה נשואה have a blanket היתר? What is the מקור of the right of the husband to stop his wife from doing כיבוד אב ואם? Does the husband have a “זכות” or is it a "חיוב כבוד לבעלה" ?  Enjoy!!

ללמוד וללמד למה מנה הרמב"ם מצות ללמוד וללמד בחד מצוה  מהו גדר חיוב האב על הבן ללמדה תורה, האם נתחייב לצורך הבן לסייעו לקיים חיובו ללמוד או שהוא חיוב האב למסור התורה במסורה מדור דור.  וגם יש לדון על חיוב כל חכם ללמד לתלמידים, האם זה לגרום לימוד התורה ומסירת התורה מדור דור, או שהוי לתועלת המלמד ומדרכי קנין תורה לפלפל בתלמידים שעי"ז מרחיבין דעת המלמד בלימודו.

חינוך בדעות וחינוך במצות Our גמרא says that the age of chinuch is 16-22 or 18-24. Is teaching children less than that age not chinuch?? What is it?? We know that there is a מצות חינוך  on all children less than bar mitvah age,  to buy him a lulav, sit in the sukkah… is that not "חינוך"?? Why is the proper time for marriage coincide exactly with the age of חנוך לנער ע"פ דרכו?? Find out the two dinim in "חינוך" as explained by the Brisker Rav. Enjoy!!

קנין אגב   יש לדון בקנין אגב... האם יש מעליותא כשהמטלטלין ציבורים, אע"פ שפסקינן שאי"צ ציבורים.  האם יכול לקנות מטלטלין של הפקר בקנין אגב.  האם צ' אמירה של "עם" או של "אגב".  האם אמרינן כלתה קנינו כשקונה הקרקע עכשיו והמטלטלין לאחר ל'.   וכ"ז תלוי בחקירה בגדר קנין אגב,  אי נימא הכוונה דהמטלטלין כחלק של הקרקע ונחשבין כהקרקע עצמה וממילא אותו מעשה הקנין שעושה על הקרקע מועיל נמי על המטלטלין או נימא שכיון שהמטלטלין טפלין להקרקע נקנין המטלטלין לזה שקונה את העיקר דהיינו הקרקע  בלא שום מעשה הקנין.   Bonus Q- If you eat cereal and milk and make a bracha only on the cereal (עיקר וטפל), and then you finish the cereal, do you now make a second separate bracha on the milk because it is not anymore טפל to the cereal?!?

There are two parts to a transfer of ownership 1- מעשה קנין  2-דעת  . What is the relationship between the two parts? Is the   מעשה קנין  the main component and there is a תנאי  that you need  דעת, or are they equal partners in effecting the change of ownership, or maybe the גמירת דעת  is the entire cause, and the  מעשה קנין is there to solidify his conviction of his  דעת to establish a true גמירת דעת  !?!? Enjoy!!

The gemara says that במקום שכותבין שטר we do not rely on the קנין מעות, is that a סברא or a תקנת חכמים? Here comes the third  פשט in the gemara of אי פריש פריש. Enjoy!!

What would it take for me to prove that I really am סומך דעת? Is "אי פריש פריש" just a regular תנאי שבממון or maybe it is really something else. Enjoy!!

If  חז"ל say that one is not סומך דעת in this type of situation, are you believed to say that you areסומך דעת? Why is the תנאי of אי פריש פריש relevant to our gemara, and what is the chiddush, it is a regular תנאי שבממון that always works? Enjoy!!

What is the הבנה  in the קנין משיכה? Are you קונה  because you do an action that shows ownership since this is an action usually done by owners (similar to the קנין חזקה) or is משיכה  an action of bringing the object into your domain (similar to קנין חצר)? Is קנין הגבהה  and קנין מסירה similar, related, and maybe even learned from קנין משיכה , or are they each distinct forms of קנינים  unrelated to each other? בענין מום שבגלוי בעבד כנעני The two massive issues of the sugya are... 1) Is the יציאת שן ועין a קנס  or a תשלומין 2) What is the criteria for the type of מום  that causes an עבד כנעני  to go free. Is it like מומין  that we find by קרבנות or is it a completely different set of criteria. Would it make sense that these two issues are connected and that the criteria for issue #2 is based on the reasoning of issue #1. Is the חיוב שחרור of an אדון שהפיל שן ועין  an עונש לשמים (יורה דעה'דיק) or a חיוב לחבירו (חושן משפט'דיק) ?
