(2) In the audio: The facility must maintain an average length of stay of 25 days or greater across its entire Medicare patient population. — Correct: The classification test is an average Medicare inpatient length of stay of MORE THAN 25 days, so a facility averaging exactly 25.0 days does not qualify. The average is also narrower than the whole Medicare population: since October 1, 2015 it excludes discharges paid at the site-neutral rate and those paid by Medicare Advantage. (3) In the audio: If the government proves the clinic falsely billed them for $1 million, the court can find the clinic three times that amount, $3 million, plus additional penalties per individual claim. — Correct: The multiplier applies to the damages the government sustains, not to the amount billed. Those are the same number only when nothing of value was rendered; whenever part of the service was legitimate, the loss is smaller than the billing and the treble figure is smaller with it.
