Artis v. Atlanta Cheesecake Company

Background Dorothy Artis, proceeding pro se, appealed the dismissal of her employment discrimination suit against Atlanta Cheesecake Company. Artis alleged discrimination and retaliation in violation of Title VII of the Civil Rights Act of nineteen sixty-four and the Americans with Disabilities Act. The district court adopted the findings and conclusions of a magistrate judge’s report and recommendation, dismissing the complaint with prejudice. Artis did not timely object to the report and recommendation. The court’s reasoning Under Eleventh Circuit Rule three-one, a party who fails to object to a magistrate judge’s findings or recommendations waives the right to challenge the district court’s order based on those unobjected-to conclusions. While the court may review waived objections for plain error if necessary in the interests of justice, such review rarely applies in civil cases. The court will not conduct a plain-error analysis unless the appellant argues in her initial brief that reviewing waived objections is necessary and in the interests of justice. Here, Artis did not timely object to the report and recommendation and did not argue that justice requires review of her waived objection. What it means going forward The decision reinforces that pro se litigants are held to the same procedural standards as represented parties and that failure to object to a magistrate judge’s report within the allotted time results in a waiver of appellate review on those issues.
