Under 5 U.S.C. § 7703(b)(2), federal district courts, not the Federal Circuit, hold jurisdiction over cases involving allegations of discrimination under 5 U.S.C. § 7702, including claims based on race, age, or prior equal employment opportunity activity. Citing *Perry v. Merit Sys. Prot. Bd.* and *Diggs v. Dep’t of Hous. & Urb. Dev.*, the court determined that because the petitioner continues to pursue these discrimination claims following her appeal to the Merit Systems Protection Board, the matter must be heard in district court.
