Applying Eighth Circuit precedent, the court determined that Sun Chemical lacked actual or constructive knowledge of ongoing harassment by the employee Nevarez, as the record showed only a single past incident involving another employee rather than a pattern of behavior that would place the company on notice. Furthermore, the court found that the employer took reasonable preventative remedial action by issuing a written disciplinary warning to Nevarez, which was sufficient given his long service history and lack of prior harassment complaints.
