Court: United States Court of Appeals for the Eighth Circuit Filed: 2026-07-23 The eighth-circuit denied Gelson Yanez Orellana’s petition for review of a Board of Immigration Appeals order dismissing his appeal of an immigration judge’s denial of asylum and withholding of removal. The court held that Yanez Orellana failed to exhaust administrative remedies regarding his claim that he belonged to a cognizable particular social group based on familial relationships. Although the petitioner mentioned this issue before the BIA, the court found he did not meaningfully challenge the immigration judge’s determination or provide any argument or explanation supporting his position, constituting a waiver under 8 U.S.C. § 1252(d)(1). Because the failure to exhaust the social group claim was dispositive of the asylum request, the court declined to address the separate claim regarding the Honduran government’s inability to protect him. Furthermore, the court noted that because Yanez Orellana did not meet the standard for asylum, he could not satisfy the more rigorous burden required for withholding of removal.
