The court also granted the United States Postal Service’s motion to modify the caption to designate the Merit Systems Protection Board as respondent, pursuant to 5 U.S.C. § 7703(a)(2), because the Board dismissed the underlying appeal for lack of jurisdiction rather than reaching the merits of the personnel action.
