Court: United States Court of Appeals for the Fourth Circuit Filed: 2026-07-28 The fourth-circuit denied Emory Chiles’s petition for a writ of mandamus as moot because the district court had recently ruled on his underlying Federal Rule of Civil Procedure 60(b) motion in his 28 U.S.C. § 2255 proceedings, thereby eliminating the alleged undue delay. The court also denied Chiles’s pending motion for an extension of time to file a motion for a certificate of appealability without prejudice to his ability to refile it if he chooses to appeal the district court’s denial of his Rule 60(b) motion.
