The court applied a de novo standard of review and held that the dismissal was proper because Newlin raised, or could have raised, his claims in a prior action involving the same parties or their privies that resulted in a final judgment on the merits. Consequently, the district court’s judgment remains in effect, and any arguments not specifically and distinctly raised in the opening brief are deemed waived.
