Court: United States Court of Appeals for the Eleventh Circuit Filed: 2026-06-23 Docket: 5:25-cv-00360-MTT The eleventh-circuit dismissed the appeal sua sponte for lack of jurisdiction. The court held that the district court’s order remanding a dispossessory action to state court is not appealable because it was based on a lack of subject matter jurisdiction, which is unreviewable under 28 U.S.C. §§ 1447(c) and (d). Furthermore, the court determined the order was not otherwise appealable because the appellant did not remove the action from state court pursuant to 28 U.S.C. §§ 1442 or 1443.
