Court: United States Court of Appeals for the Eleventh Circuit Filed: 2026-06-17 Docket: 1:25-cv-00323-MW-ZCB The eleventh-circuit dismissed the appeal sua sponte for lack of jurisdiction because the district court’s March 27, 2026, order was not a final, appealable judgment. The court held that the order partially dismissing six of the nine claims in the plaintiff’s third amended complaint did not end the litigation on the merits, as three counts remained pending, and the district court had not certified the order for immediate review under Federal Rule of Civil Procedure 54(b). Furthermore, the court determined the order did not qualify for immediate appeal under the collateral order doctrine because it failed to conclusively resolve an issue completely separate from the merits that would be effectively unreviewable after a final judgment. Consequently, all pending motions in this court are denied as moot, and the case remains with the district court to proceed on the remaining claims.
