Court: United States Court of Appeals for the Eleventh Circuit Filed: 2026-08-04 Docket: 6:22-cr-00020-CEM-RMN-2 The eleventh-circuit affirmed the district court’s denial of Alejandro Acevedo Luna’s pro se motion for a sentence reduction under 18 U.S.C. § 3582(c)(2). The court held that Luna was ineligible for relief under Amendment 821 to the Sentencing Guidelines because he failed to satisfy the criteria of U.S.S.G. § 4C1.1(a)(7), which requires that a defendant not have possessed, received, purchased, transported, transferred, sold, or otherwise disposed of a firearm in connection with the offense. The court determined that Luna was ineligible for this adjustment for the same reason he was previously found ineligible for safety-valve relief under 18 U.S.C. § 5C1.2(a)(2): he possessed a loaded firearm during the commission of his drug trafficking offense. Consequently, the district court correctly declined to consider the factors set forth in 18 U.S.C. § 3553(a).
