The court rejected Mobley’s argument that the statute is unconstitutional as applied to nonviolent prior convictions under *New York State Rifle & Pistol Association, Inc. v. Bruen* and *United States v. Rahimi*, holding that his challenge is foreclosed by binding circuit precedent. Specifically, the court relied on *United States v. Dubois* and *United States v. Rozier*, which establish that felons are categorically disqualified from exercising Second Amendment rights and that felon-in-possession bans remain presumptively lawful under current Supreme Court jurisprudence. Because a prior panel’s holding is binding on subsequent panels unless overruled by the Supreme Court or the court sitting en banc, the court was required to reject the constitutional challenge and affirm the conviction.
