The court held that the City’s denial of a final Certificate of Occupancy constituted an unreasonable enforcement of land use regulations that caused a nuisance under Missouri law, satisfying the elements of inverse condemnation because Northland’s grading complied with the city-approved plat and accepted practices. Regarding equal protection, the court found the City intentionally treated Northland differently from similarly situated property owners without a rational basis for doing so. However, the court reversed the damages award because the district court calculated losses based on the diminished value of the lot while also ordering the issuance of the Certificate of Occupancy, which would result in double recovery; the case is remanded to recalculate damages based on the diminution in value of the use and occupancy of the property for the specific period during which the harm occurred.
