Court: United States Court of Appeals for the Ninth Circuit Filed: 2026-06-05 Docket: 1:22-cv-00452- The Ninth Circuit affirmed the district court’s denial of Gerald Ross Pizzuto, Jr.’s federal habeas corpus petition challenging the denial of his clemency request and the subsequent state judicial review. The panel held that Pizzuto is not entitled to relief because his claim is not cognizable in federal habeas proceedings as it constitutes a challenge to the Idaho Supreme Court’s interpretation of state law rather than a violation of federal law. Furthermore, even assuming the claim were cognizable, the court concluded that Pizzuto failed to demonstrate a federal due process violation under the Antiterrorism and Effective Death Penalty Act (AEDPA). The panel determined that the Idaho Supreme Court’s summary denial of rehearing was an adjudication on the merits entitled to deferential review. Under AEDPA standards, the state court’s decision was not contrary to or an unreasonable application of clearly established federal law because Pizzuto failed to show that the Idaho Supreme Court’s ruling was so arbitrary as to violate due process, particularly given that the Governor’s rejection of the clemency recommendation was based on the severity of his crimes and complied with state statutory requirements.
