Court: United States Court of Appeals for the Fifth Circuit Filed: 2026-07-29 The fifth-circuit affirmed the district court’s grant of motions to compel arbitration and dismiss the plaintiff’s suit challenging vehicle repossession. The court held that the plaintiff waived any challenge to the validity of the arbitration agreement in the purchase agreement by failing to address it on appeal, despite admitting she signed that document. Because the plaintiff did not dispute the district court’s determination that the signed purchase agreement contained a valid arbitration clause, the appellate court affirmed the judgment on that basis alone without addressing her challenges to the retail installment sale contract. The practical consequence is that the case remains dismissed and subject to arbitration. Do It For The Case Law is a news reporting service. Nothing in this episode constitutes legal advice.
