Court: United States Court of Appeals for the Fifth Circuit Filed: 2026-06-26 The Fifth Circuit affirmed the defendant’s revocation sentence, rejecting his argument that “standard” supervised release conditions listed in the written judgment should be stricken due to an alleged conflict with the district court’s oral pronouncement. Applying the plain error standard of review established in *United States v. Diggles*, 957 F.3d 551 (5th Cir. 2020) (en banc), and relying on the precedent set in *United States v. Gomez*, 960 F.3d 173 (5th Cir. 2020), the court held that because the district court orally adopted the conditions from a prior judgment, the defense had ample notice of their contents and an opportunity to object. The court found that these actions left no doubt regarding the conditions adopted at the resentencing hearing and created no actual conflict between the oral pronouncement and the written judgment.
