Case Explained: Summary Calendar United States of America Plaintiff— v. Walter J. Massey, Jr Defendant—
from DIFTCL: Federal Narrative Summaries · host amf-wp
Court: United States Court of Appeals for the Fifth Circuit Filed: 2026-07-01 The Fifth Circuit vacated the portion of the judgment imposing specific discretionary standard conditions of supervised release and remanded the case to the district court to amend the written judgment. The court held that because the district court failed to orally pronounce conditions 2 through 9 and 11 through 13 at sentencing, these terms could not be enforced against the defendant. Applying the rule established in *United States v. Alexander Martinez*, the court found that the written judgment conflicted with the oral pronouncement of the sentence, thereby depriving the defendant of an opportunity to object. Consequently, the challenged conditions must be stricken from the written judgment, while the remainder of the supervised release sentence was affirmed.
