Court: United States Court of Appeals for the Ninth Circuit Filed: 2026-07-30 Docket: 2:25-cv-00787-RSM The ninth-circuit vacated the district court’s dismissal of a pro se pretrial detainee’s 42 U.S.C. § 1983 action alleging deliberate indifference to serious medical needs and remanded for further proceedings. The court held that the district court abused its discretion in dismissing the case for failure to prosecute and non-compliance with a screening order because the record reflected that the plaintiff timely filed the required amended complaint on May 15, 2025. On remand, the district court is directed to consider the plaintiff’s amended complaint. The court also denied the plaintiff’s motion for appointment of counsel.
