Court: United States Court of Appeals for the Eighth Circuit Filed: 2026-07-01 The eighth-circuit reversed the district court’s grant of summary judgment in favor of the United States and remanded the case with instructions to dismiss the government’s collection action as time-barred. The court held that 28 U.S.C. § 2462, which imposes a five-year statute of limitations on actions for the enforcement of any civil fine, penalty, or forfeiture, applies to debt collection proceedings initiated under the Debt Collection Improvement Act (DCIA) when the underlying obligation is a non-compensatory penalty. The court applied the standard that statutes of limitations do not apply to the United States absent clear congressional intent, but found such intent in § 2462’s explicit text covering “enforcement” of penalties. The court reasoned that OSHA citations and penalties are punitive measures designed to punish violations and deter future offenses rather than compensate the government for losses, thereby qualifying as “penalties” under § 2462. Consequently, the five-year limitations period began to run when the administrative process resulted in final orders for the penalties in July and November 2017. Because the government filed its collection suit in January 2023, more than five years after the penalties became final, the action was barred. The court rejected the government’s argument that the limitations period should accrue only after debts were transferred to the Treasury following a 180-day delinquency period, noting that the DCIA permits litigation prior to such transfer and does not toll the statute of limitations for administrative offsets in this context.
