The court held that the district court did not clearly err in applying a five-level sentencing enhancement under U.S.S.G. § 2K2.1(b)(5)(C) (2024), which mandates an increase if a defendant induces another to purchase two or more firearms knowing the recipient is prohibited from possessing them, or conspires to do so. Applying de novo review to the guideline interpretation and clear error review to factual findings, the court determined that Duffy induced his girlfriend to purchase two handguns for him and alternatively conspired with her to obtain them, noting that the enhancement applies based on the defendant’s receipt of the firearms rather than the purchaser’s ownership intent.
