Court: United States Court of Appeals for the Eighth Circuit Filed: 2026-06-24 The eighth-circuit affirmed the conviction and sentence of Nicholas Dewayne Rogers, holding that his challenge to the denial of his motion to suppress evidence was waived. The court applied the rule that a guilty plea waives all suppression issues not expressly reserved by a conditional plea under Federal Rule of Criminal Procedure 11(a)(2). Because Rogers entered an unconditional guilty plea without reserving the right to appeal the suppression ruling and offered no argument that his plea was unknowing or involuntary, he is estopped from challenging the district court’s denial of his motion based on alleged lack of reasonable suspicion.
