California* and dismissed the appeal because the defendant’s valid and enforceable plea agreement contained an appeal waiver that barred the challenge to the substantive reasonableness of his sentence. Applying the standard for reviewing such waivers as set forth in *United States v. Scott* and *United States v. Andis*, the court conducted an independent review of the record pursuant to *Penson v. Ohio* and determined that no non-frivolous issues existed outside the scope of the waiver. Consequently, the appeal was dismissed without reaching the merits of the sentencing claim.
