Court: United States Court of Appeals for the Ninth Circuit Filed: 2026-06-05 The ninth-circuit granted the petition for review and remanded the case, holding that Jose Alberto Vazquez Macias derived United States citizenship from his naturalized mother under former 8 U.S.C. § 1432 (1994). The court applied a de novo standard of review to determine whether the statutory requirement of “legal separation” between Vazquez’s parents was met before he turned eighteen. The court concluded that abandonment of the marital home for more than six months under Baja California law constitutes a “final breakup of the marriage,” satisfying the legal separation requirement. Furthermore, the court determined that a 1996 Tijuana Court Order authorizing immigration procedures for Vazquez constituted sufficient “court-ordered recognition” of this abandonment, as it explicitly found the father had abandoned the family for approximately nine years.
