The conviction turned on whether the Second Circuit's established "righto-to-control" theory is sufficient to establish federal wire fraud. The Supreme Court held that the right to valuable economic information is not a traditional property interest and therefore cannot form the basis for a wire fraud conviction under the relevant statutes.
