Episode 12 : Equality Rights with Professor Kerri Froc

When the Canadian Charter of Rights and Freedoms took effect, no one knew what its equality guarantee would actually require. In this episode of Shaping Canada, host Hugo Martin speaks with Professor Kerri Froc of the University of New Brunswick about Andrews v. Law Society of British Columbia (1989), the first case to define discrimination under Section 15. Froc traces the pre-Charter "horror story" of equality law, the deliberate drafting of Section 15, and how the grounds-based test built in Andrews still governs equality claims today, from intersectionality to Section 28 and the notwithstanding clause.
