In Episode 644, we observed that Judge Steven J. Hippler the district court judge in the capital case styled as Idaho J. Hippler addressed the possibility of appointing a special prosecutor to investigate possible violation of the non-dissemination (a/k/a "gag" order) that has been in effect since January 3, 2023 during the May 15, 2025 Final Pre-Trial Conference. The Court indicated that he would enter a written order directing the State of Idaho and Defense to maintain all applicable records concerning possible violations of said non-dissemination order, less than a week after alleged evidence from the case under seal was produced in the mass media.
