ICE Arrested People Under Authority It Made Up. The DOJ Just Admitted in Court. But Says Arrests STAND!

The Department of Justice filed a letter in federal court admitting that ICE lied about its legal authority to arrest people at immigration courts. ICE had a May 2025 guidance memo about courthouse enforcement that the DOJ cited in multiple briefs and at oral arguments. This week ICE informed the DOJ that the memo never applied to immigration courts. The DOJ withdrew portions of four briefs and apologized to the court - then said none of this affects the validity of the arrests. ICE has $75 billion in funding from last year’s budget bill while TSA agents haven’t been paid in 41 days and over 480 have quit. Democrats have tried six times to fund TSA, FEMA, and the Coast Guard. Republicans blocked every attempt because Trump won’t sign anything without the SAVE Act, which his own Senate leader calls “not realistic.” Every arrest made under fabricated authority can now be challenged in court.
