Denezpi v. United States | Case No. 20-7622 | Date Argued: 2/22/2022 | Date Decided: 6/13/2022Background: In April 2017, a Court of Indian Offenses in Colorado prosecuted petitioner Merle Denezpi for violations of federal regulatory laws and the code of the Ute Mountain Ute Tribe. In June 2018, more than a year after sentencing for those offenses, a federal court in Colorado indicted Mr. Denezpi for one count of aggravated sexual abuse. The indictment was based on the same incident for which Mr. Denezpi had been prosecuted and sentenced in the Court of Indian Offenses. Mr. Denezpi moved to dismiss the indictment on double jeopardy grounds.Question Presented: Whether the Court of Indian Offenses of Ute Mountain Ute Agency is a federal agency such that a defendant's conviction in that court bars a subsequent prosecution for a federal offense arising out of the same incident.Holding: The Double Jeopardy Clause does not bar successive prosecutions of distinct offenses arising from a single act, even if a single sovereign prosecutes them.Result: Adjudged to be AFFIRMED.Voting Breakdown: 6-3. Justice Barrett delivered the opinion of the Court, in which Chief Justice Roberts and Justices Thomas, Breyer, Alito and Kavanaugh joined.
