Collier | Case No. 21-5592 | Date Argued: 11/9/2021 | Date Decided: 3/24/2022Question Presented: Under the Free Exercise Clause and Religious Land Use and Institutionalized Persons Act ("RLUIPA"), if a prisoner requests a religious accommodation that the state rejects, must the prisoner prove that the state has substantially burdened his religious exercise, or does the state need to prove that its denial of the religious accommodation satisfies strict scrutiny?Holding: Ramirez is likely to succeed on his RLUIPA claims because Texas’s restrictions on religious touch and audible prayer in the execution chamber burden religious exercise and are not the least restrictive means of furthering the State’s compelling interests.Result: Judgment REVERSED and case REMANDED.Voting Breakdown: 8-1.
