United States | Case No. 20-1410 | Date Argued: 3/1/2022 | Date Decided: 6/27/2022Background: A physician otherwise authorized to prescribe controlled substances may be convicted of unlawful distribution under 21 U.S.C. § 841(a)(1) if his prescriptions "fall outside the usual course of professional practice." United States v. Moore, 423 U.S. 122, 124 (1975).Question Presented: Whether a physician alleged to have prescribed controlled substances outside the usual course of professional practice may be convicted under Section 841(a)(1) without regard to whether, in good faith, he "reasonably believed" or "subjectively intended" that his prescriptions fall within that course of professional practice.Holding: Section 841’s “knowingly or intentionally” mens rea applies to the statute’s “except as authorized” clause. Once a defendant meets the burden of producing evidence that his or her conduct was “authorized,” the Government must prove beyond a reasonable doubt that the defendant knowingly or intentionally acted in an unauthorized manner.Result: Judgment VACATED and case REMANDED.Voting Breakdown: 9-0. Justice Breyer delivered the opinion of the Court, in which Chief Justice Roberts and Justices Sotomayor, Kagan, Gorsuch and Kavanaugh joined.
