The Tribunal recalls that special protection is based on Article 19 of the Italian Consolidated Immigration Act, which prevents the expulsion of a foreign national when removal from Italy would lead to a violation of fundamental rights, especially the right to respect for private and family life. In the case examined by the Tribunal of Venice, the judges carried out the typical comparative assessment required by case law. This means comparing two situations: the life the person has built in Italy and the situation the person would face if returned to the country of origin.
