I am Attorney Fabio Loscerbo.Today we are discussing an important decision of the Regional Administrative Court of Valle d'Aosta, published on 10 November 2025, concerning General Register Case Number 1 of 2025.The case concerned the refusal to renew a residence permit for job seeking. The Police Headquarters argued that the applicant's administrative and criminal records demonstrated a level of social dangerousness that justified denying the renewal request.The applicant challenged that decision, explaining that he had lived in Italy for many years, where he had established family ties, employment prospects, social relationships, and professional qualifications. He argued that the mere existence of criminal records cannot automatically justify the refusal of a residence permit.During the proceedings, the Court ordered the administration twice to produce the documentation supporting the allegations contained in the refusal decision. However, the administration failed to comply with either order.This proved to be a crucial factor. The Court found that the decision lacked adequate reasoning because it did not explain the current and concrete grounds for considering the applicant socially dangerous. The administration's failure to respond to the Court's requests also strengthened the applicant's arguments.The judgment reaffirms an important principle of immigration law: criminal records alone cannot automatically lead to the denial of a residence permit. Public authorities must carry out an individual, up-to-date, and proportionate assessment of each person's situation.For these reasons, the Regional Administrative Court of Valle d'Aosta upheld the appeal and annulled the refusal decision, while leaving the administration free to reconsider the application through a properly reasoned assessment.Thank you for listening to this episode of Immigration Law.
