Today we are discussing a recent decision of the Emilia-Romagna Regional Administrative Court, published on June 4, 2026, concerning an important issue for foreign workers who enter Italy through the seasonal work quota system. The case involved two foreign nationals who had legally obtained entry visas based on work authorizations issued for seasonal agricultural employment. However, after arriving in Italy, they discovered that the employer who had requested their entry was no longer available, and the employment relationship never actually began. The workers then applied for a residence permit for job seeking, arguing that they should not be penalized for circumstances beyond their control. The application was rejected by the authorities, and the Administrative Court upheld that decision. According to the judges, a job-seeker residence permit can only be granted when an employment relationship has already been established and is later terminated for reasons not attributable to the worker. In this case, the residence contract had never been signed and the employment relationship had never started. For this reason, the Court concluded that the legal requirements for obtaining a job-seeker residence permit were not met. This is a particularly important ruling because it concerns a situation that is far from uncommon and may affect many workers who legally enter Italy through the seasonal work quota system.
