Here, we provide pure opinions, commentary and speculation regarding defense expert Sy Ray's statements in a recent interview that Mr. Kohberger might be considering a potential appeal of his conviction; and the compelling use of the term "miscarriage of justice" while doing so, a possible reference to the June 2026 Supreme Court landmark ruling of Hunter v US where waiver of appellate rights may be overcome. The crucial deadline for Mr. Kohberger to file a Petition for Post Conviction Relief is rapidly approaching, causing us to ask the rhetorical question of will he or won't Mr. Kohberger file?
