Speaking in the Restroom While Not Performing Bodily Functions

In an earlier installment in this series, we noted that Halacha forbids having a conversation while using the restroom. The question arises as to whether this applies when one is in the restroom for reasons other than performing bodily functions, such as to use the mirror for combing one's hair or putting on makeup, or while bathing a child. Is speaking in the restroom always forbidden, or only when one is performing his bodily functions? Rav Yisrael Bitan answered this question by noting two rulings of the Shulhan Aruch which appear, at first glance, contradictory. In one context, the Shulhan Aruch writes that one may speak about mundane matters (as opposed to Torah matters) in the restroom, whereas in a different context, he indicates that speaking in the restroom is forbidden altogether. Different answers have been offered to reconcile these two passages in the Shulhan Aruch, but likely the simplest and most compelling explanation is that the latter ruling refers to a person who performs his bodily functions, when speaking is forbidden. When one is in the restroom for other reasons, speaking is allowed. In light of this, Rabbi Bitan concluded that if one enters the restroom for a purpose unrelated to bodily functions, it is entirely permissible to speak (though one must of course refrain from speaking about Torah matters). During the moments when one performs his bodily functions, speaking is strictly forbidden. When one uses the restroom to perform his bodily functions, then during the time when he is not actually relieving himself, he may speak if a need arises. The Kaf Ha'haim (Rav Yaakov Haim Sofer, Baghdad-Jerusalem, 1870-1939) writes that according to Kabbalistic teaching, one should always refrain from speaking in the restroom, under any circumstances. However, it is likely that this does not apply nowadays, when, due to modern plumbing, our restrooms are far cleaner and more hygienic. Summary: Speaking is forbidden while performing one's bodily functions, but speaking is allowed when one is in the restroom for other reasons. If one uses the restroom, and there is a need to speak, he may do so during the moments when he is not actually relieving himself.
