d4vd — the preliminary hearing put sealed evidence into open court and the defense used every minute of cross-examination to attack the prosecution's physical evidence. Blair Berk established that all three chainsaws recovered from the defendant's residence tested negative for blood. Prosecutors never ordered DNA testing on any of them. The tools that the prosecution says were used in the alleged dismemberment of Celeste Rivas Hernandez have no biological material connecting them to the crime.Berk also went after evidence handling: the cadaver bag was not fully preserved during collection and the burn cage was not seized during the initial search. If the prosecution's theory depends on these items, the defense is arguing the items don't support the theory.On the financial side, testimony established that the defendant earned more than ten million dollars. But the defense showed that his mother and his financial manager handled virtually all transactions — building distance between the defendant and any alleged financial motive. Three special circumstances are alleged: lying in wait, financial gain, and the allegation he acted to eliminate a witness.
