Nobody in Plymouth Superior Court knows yet if Lindsay Clancy is going to take the stand in her own defense, and it might be the single biggest decision left in this trial. Lindsay is charged with three counts of first-degree murder in the deaths of Cora, five, Dawson, three, and eight-month-old Callan, at their Duxbury, Massachusetts home in January 2023. She's pleading not guilty by reason of insanity. She checked herself into a psychiatric hospital on New Year's Eve after telling her husband she was having thoughts of hurting her children. She was discharged. Nineteen days later, the children were dead. Her attorney puts her medication count at roughly thirteen psychiatric drugs across about four months, with a dose increase and a sleepless night the day before it happened. Jury selection began July 20, opening with prosecutors moving to challenge the defense's experts, the third motion in eleven days aimed at limiting who speaks for Lindsay. Prosecutors had already dropped all three strangulation charges on July 9, and on July 13 the judge blocked women who've survived postpartum psychosis from testifying about it in their own words. Criminal defense attorney Bob Motta, host of Defense Diaries, joins Tony Brueski to break down whether a jury can hold two ideas at once: that someone can plan something and still be nowhere near reality, and how the Massachusetts burden of proof in insanity cases shapes the prosecution's strategy.
