James Bertini is the attorney who was successful in blocking Apple, Inc trademark for Apple Music. But James is the younger brother of Jazz trumpeter Charlie Bertini, yes that's right a bother coming to the aid of another. The U.S. Court of Appeals for the Federal Circuit rejected Apple's argument that it had priority over Charlie Bertini's "Apple Jazz" trademark rights based on its ownership of an earlier trademark from the Beatles' music label Apple Corps Ltd. Apple launched its streaming service in 2015 and applied the same year for a federal "Apple Music" trademark covering several categories of music and entertainment services. Bertini opposed the application, arguing the name would cause confusion with the "Apple Jazz" branding he had used since 1985 to advertise concerts. James spoke to Folksalert from his home in Colorado, and express he is very please with the outcome, but said there is still a pending case where he has filed to cancel a Apple, Inc, Trademark the company haas never used and Trademark law clearly express that one cannot maintain a trademark they have not used.
