После внесения изменений в российский Кодекс административного судопроизводства появилась новая возможность получить денежную компенсацию за ненадлежащие условия содержания в российском суде.В связи с этим изменением Европейский суд в своем решении «Шмелев и другие против России» пришел к выводу, что все, кто уже подал жалобу в ЕСПЧ на нехватку личного пространства и перенаселенность в местах заключения (наряду или нет с другими нарушениями условий содержания), должны воспользоваться новым механизмом до 24 июля 2020 года. Иными словами, подать иск о компенсации в российский суд. В противном случае, ЕСПЧ будет считать жалобы неприемлемыми и откажет в рассмотрении.
