When Life Changes: Revoking Power of Attorney in Texas | S3EP64

Episode Summary: When life changes, moving, marriage, or shifting relationships, you may want to change who can make decisions for you. In this episode of Thoughtful Planning, Honey and Santiago explain how to revoke a Medical Power of Attorney or a Texas Statutory Durable Power of Attorney (Financial POA). They cover what revocation means, how the eFileTexas guided tool works, why notarizing helps, and how to make sure the revocation is actually honored. Essential Question: If you signed a Medical Power of Attorney or a Statutory Durable Power of Attorney and you want to revoke it, what steps help make sure your revocation is clear and actually honored? Episode Highlights: [00:00] When life changes and you want to update your decision-maker [00:44] Today’s topic: revoking medical POA or financial POA in Texas [01:07] Disclaimer and Texas-based context [02:15] Today’s essential question [02:40] What revoking a POA means, canceling your agent’s authority [03:26] Written revocation is not always required, but often recommended [03:42] Why notarizing helps with banks and businesses [04:05] Using the free eFileTexas revocation tool [04:30] What info the interview asks for [05:49] Sign in front of a notary and keep your signed copy [06:04] The step people miss: deliver copies and update records [06:20] Who to notify for Financial POA revocation [07:27] Who to notify for Medical POA revocation [08:28] Before you revoke, consider a replacement agent [09:01] Medical POA vs HIPAA authorization, separate documents [10:12] Final recap: revoke it, then make sure the right people know Takeaways: • Revoking a POA cancels your agent’s authority, but it only protects you if the right people and institutions are aware it has changed. • A written revocation creates a clearer paper trail, and notarizing it can help institutions take it seriously. • After revocation, give copies to your former agent and any places that relied on the old document. • For medical decisions, make sure your doctor and healthcare providers update what they have on file. • HIPAA authorization is separate from a Medical Power of Attorney, and revoking generally must be done in writing. Action Steps: Decide whether you are revoking your Medical POA, Financial POA, or both. Use the eFileTexas guided interview or a written revocation for a clear paper trail. Sign the revocation in front of a notary public. Deliver copies to your former agent and any institutions or providers that relied on the old document. Keep a list of who received copies and when. If needed, complete new documents to name a replacement agent. Parents + 18-Year-Olds: The “Just-in-Case” Form for Money Emergencies | S3EP63

Episode Summary: When a young adult turns 18, parents no longer automatically have access to their child’s finances. That can create problems during emergencies, especially if money needs to be moved, bills need to be paid, or accounts need attention while the young adult is unavailable. In this episode of Thoughtful Planning, Honey and Santiago explain the Texas Statutory Durable Power of Attorney (Financial POA). They discuss what the document does, why a young adult might want one, how it works, and how to complete the Texas form. Essential Question: What is a financial power of attorney, why might a young adult in Texas want one, and how do you complete it? Episode Highlights: [00:00] A college emergency scenario many families don’t expect [00:30] Introducing the Statutory Durable Power of Attorney (Financial POA) [00:50] Welcome to Thoughtful Planning and who we are [01:07] Disclaimer and Texas-based context [02:15] Today’s essential question [02:40] What a power of attorney means in simple terms [03:00] What “durable” means [03:38] Financial POA vs medical POA [03:55] Principal, agent, and alternate agent explained [04:25] Why co-agents can complicate things [05:24] What changes when a teen turns 18 [05:56] Real situations where a financial POA helps [06:36] Important reminder: the young adult keeps control [06:55] Types of financial powers in the form [08:22] Banking and financial institution transactions [08:38] Business transactions and side hustles [09:40] Personal and family maintenance expenses [10:45] Digital assets and online accounts [11:02] Compensation, gifts, and special instructions [12:44] When the POA becomes effective [14:07] Choosing a trustworthy agent [15:11] Legal responsibilities of the agent [15:58] Where to find the Texas forms [16:26] Using the eFileTexas guided interview [16:56] Signing the document with a notary [17:48] Why banks may require additional steps [18:22] Asking your bank about Payable on Death (POD) [19:27] Revoking a financial POA if needed [19:43] Final recap Takeaways: • A Financial POA allows someone you trust to handle financial matters on your behalf. • “Durable” means the document can still work if you become unable to manage your finances. • A young adult keeps full control; the document simply creates a backup. • Banks and financial institutions may have their own procedures for accepting a POA. • Choosing the right agent is critical because they may act in your name. Action Steps: Talk with your young adult about financial emergencies before they turn 18. Decide who they trust to act as their financial agent. Review the powers in the form and select only what makes sense. Sign the document in front of a notary public. Ask your bank what they require to keep a POA on file. Her family faces an impossible choice: keep her on life support indefinitely or allow natural death. The problem? They're guessing what she'd want because she never told them. In this episode, we walk through the critical thinking work you need to do BEFORE filling out your living will so your wishes are clear when it matters most. Essential Question: What decisions do you have to make about your values and priorities before you can meaningfully complete your advance directives? Episode Highlights: 00:03 - Simone's story: Why preparation matters 02:43 - Understanding advance directives (it's more than one form) 04:27 - Texas Living Will basics (and how to find your state's forms) 06:04 - The problem: Why people freeze mid-form 08:02 - The Emory Guide: Your prep work tool 10:24 - Terminal vs. irreversible conditions explained 12:19 - Specific treatments: feeding tubes, ventilators, CPR 14:32 - Santiago's feeding tube story 16:51 - Core values: What makes life worth living? 19:15 - Why emergency docs need quick, clear instructions 22:33 - Thinking about your healthcare agent 24:31 - Your action steps before the next episode Key Takeaways: • Advance directives are a collection of forms, not just one document • The real challenge isn't finding forms (many states offer them free) but being prepared to complete them thoughtfully • Terminal condition = expected to die within 6 months even with treatment • Irreversible condition = can be treated but never cured, can't care for yourself • The Emory Critical Conditions Planning Guide helps you clarify values before filling out legal forms • In emergencies, doctors need clear, concise wishes (not lengthy explanations) • Focus on the first 26 pages of the Emory Guide for the most critical work Action Steps: 1. Download the Emory Critical Conditions Planning Guide (link in show notes) 2. Work through scenarios - don't rush, this is deep personal thinking 3. Year 3 Kickoff: The Missing Piece in Legal Document Planning | S3EP55

Episode Summary: For years, Honey thought you needed a lawyer to get your will and advance directives done. Then she discovered many states (including Texas!) provide these documents for free. But knowing where forms are isn't enough. In this Year 3 kickoff, Honey and Santiago share the missing piece: preparation. They're launching a series to walk you through each foundational legal document, one at a time. Essential Question: What's the difference between knowing where to find legal documents and actually being prepared to complete them? Disclaimer: This episode is for educational purposes only. We are not attorneys, financial advisors, or medical professionals. Key Takeaways: ✅ Many states provide free legal document templates online (availability varies) ✅ Attorneys are valuable for complex assets, blended families, business owners, special needs families ✅ Preparation is key - make decisions BEFORE filling out forms ✅ Different documents need different people (medical POA ≠ financial POA ≠ executor) ✅ At 18, parents lose automatic access to medical records (April's story) ✅ Series focuses on Texas forms, but preparation applies universally In This Episode: [0:04] Cold open: Free state legal documents discovery [1:21] Disclaimers & when to use attorneys [2:33] Reflecting on 3 years of learning [4:38] April's story: 18-year-old medical surprise [5:36] New series introduction (Texas focus) [7:47] Why forms sit half-finished [9:20] Start your planning notebook [12:08] Next episode preview [12:28] Essential question & attorney discussion [17:37] Homework assignment [19:11] Closing thoughts Action Steps: 📝 Start a "Legal Documents Journey" notebook (paper or digital) 👥 Create "People to Consider" section with contact info 💭 Think about who's good with finances vs. medical vs. organization ⏸️ Don't finalize yet, just brainstorm 📲 Share with parents of 17-18 year olds Resources Mentioned: AARP Legal Documents Links: https://www.aarp.org/caregiving/financial-legal/free-printable-advance-directives/ April's Episode: https://youtu.be/FKbdbbY7TxI Coming Up Next: Next Episode: Advance Care Directives - Your Voice When You Can't Speak We'll cover what they are, why you need one, questions to ask yourself, and conversations to have. Exploring End-of-Life Options S2EP31

Summary: In this episode of Thoughtful Planning, Honey and Santiago delve into the complex and often misunderstood topics of Medical Aid in Dying (MAID) and Voluntary Stopping Eating and Drinking (VSED). As part of their journey in end-of-life planning, they discuss the emotional and legal intricacies of these options, providing insights to help individuals and families navigate these deeply personal decisions. Disclaimer: This episode is for educational purposes only and should not be considered medical or legal advice. Always consult qualified professionals for your specific situation. Today’s Essential Question: What does it mean to truly have control over the way you die? And how do these options help you achieve that? Episode Highlights: Medical Aid in Dying (MAID): Legal in 11 U.S. jurisdictions as of December 2024, MAID allows terminally ill adults to self-administer prescribed medication to peacefully end their lives. Requires multiple doctor approvals, mental competency, and adherence to strict safeguards. Not all approved individuals choose to follow through; many seek peace of mind knowing they have the option. Resources: Compassion and Choices Voluntary Stopping Eating and Drinking (VSED): An option available without legal restrictions, allowing terminally ill or chronically ill individuals to hasten death by choosing to stop consuming food and water. Requires a strong support system, including caregivers and possibly hospice involvement. A slower process compared to MAID, often taking one to three weeks. Comparing MAID and VSED: MAID is faster and legally regulated, while VSED relies solely on individual choice and support. Both require mental competency and involve significant planning and communication with loved ones and professionals. Personal Reflections: Honey and Santiago share candid insights from their own discussions, touching on their preferences, challenges, and hopes for legislative changes in Texas. The emotional impact on families and caregivers is a recurring theme, emphasizing the importance of preparation and open communication. Key Takeaways from Honey and Santiago: Start having these conversations early to ensure clarity and alignment with loved ones. Document your wishes and consider recording videos to reaffirm your decisions for future reference. Explore resources like Compassion and Choices or speak to healthcare providers to better understand your options. Conclusion: This episode aims to shed light on end-of-life options, encouraging families to embrace proactive and compassionate planning. Memorial Day: Honoring Those Who Paid the Ultimate Price EP16

This week's essential question is: What is Memorial Day? Santiago is doing a special episode on the significance of Memorial Day, a holiday often confused with Veterans Day. Let's clarify these important distinctions and honor those who paid the ultimate price for our freedom. Understanding Memorial Day vs. Veterans Day Memorial Day and Veterans Day are two distinct holidays, each with its own purpose: Veterans Day: Originally known as Armistice Day, it marks the end of World War I, celebrated on the 11th minute of the 11th hour of the 11th day of the 11th month. This day honors all veterans, living or deceased, who have served in the U.S. Armed Forces. Did you know more than 41 million Americans have served in our nation's history? Over 16 million of them served in World War II alone! Memorial Day: This day is specifically set aside to remember and honor the estimated 1.5 million service members who have died since the birth of our nation. It's a solemn day of reflection and gratitude for those who made the ultimate sacrifice. A Personal Experience: Soaring Valor I had the privilege of escorting World War II veterans to the World War II Museum in New Orleans through the Gary Sinise Foundation’s Soaring Valor program. Our cadets interacted with living history, hearing firsthand accounts from these incredible individuals. For example, we met a veteran from the third wave of Marines who assaulted Iwo Jima. The battle was devastating, with over 24,000 casualties and 6,140 deaths. To put this in perspective, more service members died in the 36-day battle of Iwo Jima than in 20 years of the war on terror. These stories highlight the enormous sacrifices made by our service members. The Meaning of Memorial Day Memorial Day is about honoring those heroes who gave their lives so we can enjoy our freedoms, including the simple pleasure of a summer barbecue. It’s a day of remembrance, not celebration. When you say "Happy Memorial Day" to a veteran, understand that it might not be a happy day for them. It’s a day of reflection and respect for their fallen comrades. Closing Thoughts I hope this episode gave you a clearer understanding of Memorial Day. Remember, Veterans Day honors all veterans, while Memorial Day is dedicated to those who died serving our country. Thank you for joining me today. Until next time, remember: every chapter you write today shapes your legacy tomorrow. Have a fantastic day! Ensuring a Future for Texx: Planning for Pets in Our Absence EP 15

In this episode of Thoughtful Planning, we shift the conversation to one of the most important parts of our lives--our pets. Our essential question asks, “How can pet owners ensure that their pets are well taken care of and secure in the event of a long-term absence or passing?” In celebration of National Pet Month this May, we talked about our baby boy Texx, a two-year-old boxer with a huge personality. We realized that we never documented who’s going to take care of our dog, and this episode is also us getting started on that. The least you can do is talk to friends and relatives who you can leave your dog with in the event that you get in an accident or you never return. Make sure you communicate clearly and get their agreement. It’s also good to get several options, since people’s circumstances may change and they might end up not being able to care for a pet anymore. What if you do not make arrangements for someone to care for your dog? Research shows the dog will either: Go to an animal shelter or rescue organization that would try to rehome your dog. The shelter might offer foster care for your pet until the pet is adopted. There are sanctuaries that take in pets if it’s a good fit and they have space. Do dogs grieve for their owners? Research shows that dogs do grieve after their owner or another pet companion passes. Signs of grieving include decreased activity, loss of appetite, changes in sleep patterns, mood changes, and vocalizations. How can you help your pets through the grieving process? Maintain their regular routine. It’s helpful if they are still surrounded by what’s familiar. Give them physical contact. They need hugs, cuddles, and belly rubs. Provide them with enough play and exercise. Make sure they get to have social interaction under the supervision of a veterinarian or pet behavioral specialist.. For depression seek the help of a veterinarian. To help you through this planning process for your pets, we are sharing with you all the questions we asked and the steps we took to prepare, all in one document. We know how important our pets are to us, and we want to make sure that like the rest of your loved ones, they’re taken care of as well.
