    B&P Associates has in-depth experience in labour law matters, ranging from issues relating to employment, termination of employment, dismissal, and labour unions to collective bargaining. Over the years, numerous inquiries have come through to the firm concerning disciplinary actions of employees in the workplace. Insufficient knowledge in the area has resulted in some employees and employers lacking the understanding of how to initiate disciplinary measures, the appropriate timing for conducting such proceedings, the rights and responsibilities of both the employer and the employee throughout the process, and other related matters. Following on from part 1 of our Employment Series on termination of employment in general, we thought it apt to have this episode on dismissals and disciplinary hearings to create awareness on same. Our guest speaker is Mr. Ernest Osei-Afful, a Senior Corporate Counsel at Ecobank Ghana PLC and a Board Member of the Food and Drugs (FDA), Ghana where he oversees legal, HR and corporate affairs of the Authority. According to the second edition of the MasterCard Index of Women’s Entrepreneurship (MIWE), Ghana has the highest percentage of women’s business owners with a whopping 46% of the total number of business holders in the country being women. The campaign theme for International Women's Day 2024 is #Inspire Inclusion. By this episode, we therefore hope to inspire others to understand and value women's inclusion in the Ghanaian Business space. Our experiences with clients have shown that the average Ghanaian finds it difficult to meet the economic demands that accompany legal services. Accordingly, self-representation is a common phenomenon in the Ghanaian judicial system, especially in the lower courts such as the District and Circuit Court. This is particularly disturbing due to the increased risk of unfavourable judicial outcomes, which is largely attributable to the limited legal knowledge and inadequate preparation of the litigants. This episode aims to explore the world of individuals who navigate the legal system without an attorney, particularly the reasons for their struggles; and the systems that are, or can be put in place, in order to enhance their access to justice and a fair and equitable judicial system.

In our previous episode, we focused on how children can be victims of cybercrime, especially children who have unrestricted access to the internet. We discussed the various cyber risks children face on the internet, such as cyber-bullying, online grooming, online pornography, catfishing, privacy and identity theft, sexting, among others. We also discussed some efficient methods children can employ to safeguard themselves from digital threats. In this episode, our guest speaker Mr. Nelson Herald Darko, a Senior Manager of the Child Online Protection Division of the Cyber Security Authority of Ghana, returns to throw light on how parents and guardians can also put in measures to protect their wards from all these cyber risks when they access the internet.

Cybersecurity is a generic term used to describe the infrastructure of technologies, processes and practices used to protect networks, data and technology from unauthorised access or other forms of cyberattacks. Our experiences with clients have shown us how anyone can be a victim of cybercrime, especially children who have unrestricted access to the internet. On the internet, children are liable to become exposed to cyber-bullying, online grooming, online pornography, catfishing, privacy and identity theft, sexting and all other forms of cyber risks. Our guest speaker is Mr. Nelson Herald Darko, a Senior Manager of the Child Online Protection Division of the Cyber Security Authority of Ghana. He elucidates us on the potential cyber risks children face, as well as some efficient methods children can employ to safeguard themselves from digital threats.

In recent times, we have observed that a lot of people seeking to divorce often seem unaware of the intricacies involved in the process. This has led to some people feeling stuck or in some cases, thinking they are divorced when in fact they are not as the appropriate process was not followed. Our guest speaker Mrs. Frederica Ahwireng-Obeng contributes immensely to the conversation by providing us with information on how to start divorce proceedings; the grounds for divorce, how property is handled in divorce settlements, custody in divorce proceedings among others.

    The social topic to be discussed in Episode 8 of the podcast is on Marriage and themed, “I do, but how do I?”. Our experiences with clients have shown that a lot of couples live under the mistaken belief of having validly contracted an Ordinance Marriage which is created under Part III of the Marriages Act, 1884-1985 (“CAP 127”) and governed by the Matrimonial Causes Act, 1971 (Act 367) or a Mohammedan Marriage created under Part II of CAP 127. Marriages that fall short of the requirements provided for by law tend to lead to severe legal complications in respect of the status of a “spouse”, matters on succession and inheritance.

    Episode 7 (Understanding the SSNIT Pensions Scheme and its Benefits)

    B&P Associates has in-depth experience in labour and employment matters and other related issues. Over the years, we have observed that a lot of employers and employees are unaware of their obligations and rights with respect to contributions to the national pension scheme. This has, in some cases, led to the destitution of some employees after retirement and also had legal implications for employers. Our guest for this episode is Mr Charles Garshong, the Head of Public Affairs of the Social Security and National Insurance Trust (SSNIT). Mr Garshong has in-depth knowledge of the Trust and its operations and has led extensive public communication initiatives aimed at educating the public on the mandate of SSNIT and the importance and benefits of fulfilling obligations under the Pensions regulations of Ghana.

    Episode 5 (Intestate Succession Pt. 2)

    This episode is the second of the two-part episode, which discusses Ghana's laws on intestacy. In the previous episode, we discussed Ghana's present law on succession, the Intestate Succession Law, 1985 (PNDCL 111). This time, we focus on the strengths and weaknesses of the new Intestate Succession Bill, currently pending before Parliament. Upon the passage of this Bill, there will be significant variations in the current law on succession. Our guest speaker, Mrs. Sheila Y.N. Minkah-Premo Esq, joins us again in this enlightening conversation.

    Episode 4 (Intestate Succession Pt. 1)

    This episode is the first of a two-part episode, which discusses Ghana's laws on intestacy. It has been about thirty-eight years since the Intestate Succession Law, 1985 (PNDCL 111) was enacted. The primary purpose of PNDCL 111 was to prevent members of the extended family from taking over the assets of the deceased for their own use, to the detriment of the surviving spouse and children of the deceased. However, in today’s modern society, PNDCL 111 appears to be outliving its usefulness due to changes in the Ghanaian family system. Accordingly, a new Intestate Succession Bill is currently pending before Parliament. Upon the passage of this Bill, there will be significant variations in the current law on succession, particularly, the distribution of property when a person dies intestate. Our guest speaker is Mrs. Sheila Y.N. Minkah-Premo Esq, a senior lawyer, development consultant, and human rights activist. She has personally worked with some NGOs on the development of several laws relating to family, including the Intestate Succession Bill. In this episode, we have conversations with her on intestate succession generally, as well as PNDCL 111 and its strengths and weaknesses.

Miss Bame is an administrator by profession and a human rights advocate by passion. She brings to the discussion on-the-ground experience on how domestic violence victims are assisted and empowered.
